These Terms of Use (“Terms”) govern your access to and use of fulcrumlawfirm.com (the “Site”), operated by Fulcrum Law Firm (“Fulcrum,” “we,” “us,” or “our”). Please read them carefully. By accessing or using the Site, you agree to these Terms.
1. Acceptance of Terms
Your use of the Site constitutes acceptance of these Terms and of our Privacy Policy, Disclaimer, Attorney Advertising Notice, and Cookie Notice. If you do not agree, do not use the Site.
2. No Legal Advice; No Attorney-Client Relationship
Information on the Site is provided for general informational purposes only. TO THE FULLEST EXTENT PERMITTED BY LAW, FULCRUM DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND UNINTERRUPTED OPERATION. FULCRUM DOES NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FULCRUM LAW FIRM, ITS PARTNERS, LAWYERS, STAFF, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF FULCRUM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, FULCRUM’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
Nothing in these Terms limits any liability that cannot be limited under applicable law or under the Texas Disciplinary Rules of Professional Conduct.
9. Indemnification
You agree to indemnify, defend, and hold harmless Fulcrum and its partners, lawyers, staff, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of applicable law or any third-party right.
10. Governing Law and Venue
These Terms and your use of the Site are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that the exclusive venue for any dispute arising out of or relating to these Terms or your use of the Site shall be the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts. The parties expressly waive any right to trial by jury to the extent permitted by law. The parties do not agree to arbitrate disputes arising out of these Terms.
11. General Provisions
11.1 Changes to These Terms
We may update these Terms from time to time. Changes become effective when posted on this page, and the “Last updated” date will be revised. Your continued use of the Site after the effective date constitutes acceptance.
11.2 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
11.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
11.4 Entire Agreement
These Terms, together with the Privacy Policy, Disclaimer, Attorney Advertising Notice, Cookie Notice, and any applicable engagement letter, constitute the entire agreement between you and Fulcrum Law Firm with respect to the Site.
11.5 Assignment
You may not assign your rights or obligations under these Terms without Fulcrum’s prior written consent. Fulcrum may assign these Terms in connection with a merger, sale, or reorganization.
